Student accused of rape texted alleged victim to say “I have to apologise for Wednesday”

A university student accused of raping a woman as she slept later messaged her saying “I have to apologise for Wednesday”, a court heard.

Nicholas Beanland, 24, claims he never had sexual contact with the alleged victim and the message he sent to her was “sarcastic”.

He is said to have messaged the woman: “I have to apologise for Wednesday, and it’s not an excuse, but I had no idea what was going on but it doesn’t make it right and you’re correct, it’s gross.

“If it’s true, and I believe you, I am ashamed of myself. ”

Cardiff Crown Court heard Beanland became “angry” and “extremely intoxicated” as the pair, who were both students at Cardiff University, walked home after a night out and the complainant messaged a friend to say she felt scared.

Prosecutor Roger Griffiths said after arriving at her home, the complainant wanted to go to sleep so she and Beanland went to bed. She claimed she was fully clothed while he was wearing boxers.

The alleged victim then said she woke up to find Beanland having sex with her and tried to push him off.

The court heard the woman ordered him to leave the next morning and asked him “why did you do it?”

A jury was told Beanland – who was studying French and English at Cardiff University – sent her Facebook messages “apologising” the following day.

He wrote: “Hey, I know you’ll probably ignore this and I am not expecting a response.

“I have to apologise for Wednesday, and it’s not an excuse, but I had no idea what was going on but it doesn’t make it right and you’re correct, it’s gross.

“If it’s true, and I believe you, I am ashamed of myself. I want to thank you, you probably hate my guts and I don’t blame you.”

The woman is said to have messaged Beanland saying: “Don’t stick your penis in someone when they’re sleeping” and wrote in another message: “It’s f*****g rape.”

Mr Griffiths said: “She described getting into bed and falling asleep straightaway. Next thing she was aware of was pain and feeling Mr Beanland inside her.

“She didn’t understand what was happening to her and her reaction was to freeze.

“She was lying on her back and Mr Beanland was on top of her. She opened her eyes and could see him having sex with her.

“She tried to get him off and pushed his shoulders, saying ‘What are you doing? Stop’ but he didn’t react or respond.

“She described him as being like a different person and nothing was getting through to him.”

The court heard the woman later made a complaint to police and Beanland was arrested.

Beanland, who now lives in Kings Worthy, Hampshire, denies rape and assault by penetration.

Jurors heard a police interview with Beanland, in which he said he had not had any sexual contact with the woman and the Facebook messages were “sarcastic”.

The jury heard Beanland told officers: “At first I thought she was joking to be honest. A lot of them are sarcasm. I was so shocked she said it so I thought I would be sarcastic.”
